Purchase order terms for category Wired Internet connection
These Terms and Conditions of Purchase apply to the temporary provision of Internet connections and associated services on the premises of Deutsche Messe AG ("Deutsche Messe") in Hannover, as well as in connection with events organized by Deutsche Messe or guest organizers. Any deviating provisions shall require written agreement. The customer is understood to be the person placing the order via the Shop (hereinafter referred to as "Customer"). The contractor is Deutsche Messe. Deutsche Messe uses a service provider (Axians Networks & Solutions GmbH or its subcontractors) to provide the contractually agreed services, hereinafter referred to as "Contractor".
2. Dates/rent/rental period
The booking of connections, lines, and services, as well as the provision of corresponding equipment is done by placing an order in the Shop and uploading the stand sketch, at the latest by the final submission date specified therein. Orders received after this deadline will be processed in the sequence in which they are received. Provision of services is then only possible if free capacities are still available. There shall be no entitlement to the provision of services, in particular to an Internet connection.
The required communication equipment is provided to the Customer on a rental basis. The rental period begins when the equipment is put into operation and ends with its disconnection. The ordered services are generally not provided until the start of the setup period. An earlier provision date requires a separate agreement. Cancellation is free of charge up to 21 days before the start of the event and shall be done via the Shop. A cancellation fee will be charged for cancellations not made by said deadline.For orders placed by the Customer seven (7) days or less before the start of the event, the Contractor will charge a surcharge of 25%.
3. Commissioning/disconnection/return and service hotline
3.1. The commissioning, deactivation and return of provided equipment shall be ordered by telephone via the service hotline at +49 511 891 133. The order shall be accompanied by a stand plan showing the positioning of the connections.
The equipment shall be returned by the end of the dismantling period at the latest. In case of doubt, the Customer shall provide evidence thereof by presenting the Contractor's acknowledgement of receipt.
If equipment has been lost or damaged beyond repair, the list price prevailing at the time a replacement is procured shall be paid. If equipment is damaged, the repair costs shall be paid. All these costs are subject to a 10% fee to offset expenses.
The Contractor expressly reserves the right to set off the costs of repairs or of non-returned equipment against any advance payments made for services.
3.2. The Contractor may also contact the service hotline mentioned in section 3.1 in the following cases:
3.2.1. Assembly and installation of lines/services during the setup period
3.2.2. Commissioning of services and end devices during setup and the event
3.2.3. Fault reports during the event period
3.2.4. Dismantling and removal of lines or return of rental equipment
4. Responsibility for laying cables
Exclusively the Contractor shall be permitted to lay cables for telecommunication purposes outside of rented stands.
5. Approved equipment
All equipment to be connected shall comply with the German telecommunications regulations and shall be approved by the regulatory authorities for telecommunications and postal services.
Approval is issued by:
Bundesnetzagentur
Willestr. 2, D-30173 Hannover

Fax +49-(0)5 11/28 55-180
e-Mail: poststelle@BNetzA.de
Internet: http://www.bundesnetzagentur.de
If unapproved equipment is used, all connections of the applicant will be disconnected at the applicant's expense.
6. Wired Internet connection
The Internet connections are based on an existing campus network that is directly connected via fiber-optic XPON links to the Internet backbone of the respective provider (Axians Networks & Solutions GmbH). All Internet connections offered are linked to this network and constitute a complete package. This package includes the line connection to your stand, with unlimited online time and data transmission volumes (flat rate). The connection label for your Internet connection is established via PPPoE. The line termination is implemented using a provided CPE (router) and a switch at the stand. DHCP (private pool) is used to assign the IP addresses on the LAN. Should you choose not to use the provided router, an interface (RJ45, UR2) will be available. We can provide you with the access credentials (username/password) in advance on request.
7. Wi-Fi services
The MesseEnterprise Wi-Fi operates exclusively in the 5 GHz band. If a booked package includes exhibitor-specific access points, these also enable operation in the exclusive 6 GHz band. The use of privately operated Wi-Fi networks shall be registered with Deutsche Messe via a corresponding order. Privately operated Wi-Fi is permitted exclusively in the 2.4 GHz band. Sharing access credentials with third parties is prohibited. Access credentials shall be treated as confidential
8. Security & service
The Contractor endeavors to provide the campus network with a high fail-safe level adapted to the specific requirements of each event. However, 100-percent Internet availability or a guarantee for a particular throughput bandwidth cannot be assured. Likewise, the Contractor has no control over Internet routing behavior or over performance at or beyond the handover points to third-party providers.
Network stability and performance are nevertheless of the highest priority. Accordingly, the IP network on the exhibition grounds is monitored by a central network management system, enabling immediate detection of network disruptions and prompt initiation of troubleshooting by qualified WAN and LAN specialist personnel.
Note: All Internet connections made available involve fully transparent access.
End devices are only permitted to be connected if their operation excludes negative impacts on the operation of the Internet platform. Compliance with the latest manufacturer recommendations regarding service and security levels is mandatory to this end.
The Contractor reserves the right to disable ports and sockets, or entire connections, if the connected devices jeopardize the uninterrupted operation of the platform. Such disconnection will occur approximately 30 minutes after a telephone request to remedy the disruption. In cases of an acute threat to the operational capability of the Internet platform, disconnection may occur without prior notice.
9. Price information
Unless otherwise stated, prices are net prices plus statutory VAT. Only the prices shown on the order form or order screen on the day of the order apply. These are also listed in the confirmation of receipt of the order, which the exhibitor automatically receives immediately after placing his order.
10. Customer's obligations
The Customer is obligated to:
10.1. plan its stand construction activities in such a way that the activation and testing of the services it has ordered and which are provided by the Contractor, in particular the broadband Internet types, can take place as early as possible;
10.2. request activation of the lines during the entire setup period via the service hotline specified under section 3.1.;
10.3. refrain from using the provided access points improperly, including but not limited to:
- the unsolicited sending of e-mails to third parties for advertising purposes (mail spamming) or the sending of messages for advertising purposes (news spamming),
- attempts to gain unauthorized access to information and data or to infiltrate data networks without authorization,
- not using the provided access points for the transmission of threatening or harassing messages;
10.4. refrain from transmitting any threatening or harassing information, or any information with illegal or morally objectionable content, to any communication partners, and from referring them to such information. This includes, in particular, information which, within the meaning of Sections 130, 130a, and 131 of the German Criminal Code (StGB), incites criminal acts, glorifies or trivializes violence, is sexually offensive, constitutes pornography within the meaning of Section 184 StGB, is liable to seriously endanger the moral welfare of children or adolescents or to impair their well-being, or may damage the reputation of the Contractor. The same applies to the infringement of third-party rights, in particular patent rights, copyrights, trademark rights, related rights, or rights to distinctive signs;
10.5. The Customer shall observe and comply with the statutory provisions applicable to telemedia or media services, in particular the information obligations stipulated therein.
11. Liability
11.1. Customer
The Customer shall be responsible for the proper handling of all equipment and systems provided to it on a rental basis. The Customer shall be liable for compensation for any damage beyond normal wear and tear, or for any loss.
11.2. Contractor's liability
11.2.1. The Contractor shall be liable in accordance with statutory provisions for losses resulting from injury to life, body, or health, as well as for losses caused by intentional or grossly negligent conduct on the part of the Contractor, its legal representatives, or vicarious agents.
11.2.2. In the case of simple negligence on the part of the Contractor, its legal representatives, or vicarious agents, the Contractor's liability shall be excluded. Said exclusion shall apply irrespective of the legal nature of the asserted claim, including specifically claims for damages based on culpa in contrahendo, breach of other contractual duties, or tortious claims for compensation for property damage or other financial losses.
11.2.3. The exclusion of liability pursuant to section 10.2.2 shall, however, not apply in the event of a breach of duties the fulfillment of which is essential for the proper performance of the contract and on the observance of which the Client may regularly rely (material contractual obligations). In such cases, liability shall be limited to those losses which are typically foreseeable in connection with the subject matter of the contract.
12. Important information
With regard to sections 10.1 and 10.2 (activation of the lines), the Customer acknowledges and agrees that, due to continuous network reconfigurations and connections, stable operation can be ensured at the earliest 3 days prior to the start of the event.
